(A)    Before the Auction

Bidder Registration

  1. Bidders must be aged 18 or above and possess a valid Hong Kong Identity Card  or a passport (Hong Kong Special Administrative Region or another country's), have a Hong Kong or overseas correspondence address and phone number. 
  2. Bidders must be the registered members of this website.
  3. Bidders must complete a bid form with valid identification before the auction. Bidders will need to provide Time Warp Fine Art Limited (hereinafter known as “Time Warp” "we", "our" or "us") with two forms of identification — one must be photographic (such as Hong Kong Identity Card or a passport) and the other a proof of address (such as a utility bill) no more than three months old. These documents of identification must be submitted together with the bid submission before the deadline of bidding.

Pre-auction Viewing

  1. Pre-auction viewing at the office of Time Warp is open to the public free of charge at set times unless special arrangements have been made in exceptional circumstances.
  2. Bidders are strongly advised to examine in person the lots’ condition before placing their bids.

Auction Catalogue

  1. All dimensions and weight are approximate.
  2. Apart from reading the lot description in the catalogue, Time Warp advises the bidders should come to the preview of the auction and inspect the lots themselves. 

Condition of Lots

  1. All lots are sold to successful bidders on "AS IS" basis, with all existing defects and imperfections, without warranty or guaranty of any kind. Time Warp explicitly draws your attention to the fact that all lots are offered as collector’s vintage items and that the sales of them gives rise to neither warranty nor responsibility for any visible or invisible defects whatsoever.
  2. Whilst we seek to describe lots accurately, it may be impractical for us to carry out exhaustive due diligence on each lot. All bidders are given ample opportunities to view and inspect before any sale and they (and any independent experts on their behalf) must satisfy themselves as to the accuracy of any description applied to a lot. Prospective buyers also bid on the understanding that, inevitably, representations or statements by us as to authorship, genuineness, origin, date, age, provenance, condition or estimated selling price involve matters of opinion. We undertake that any such opinion shall be honestly and reasonably held and accept liability for opinions given negligently or fraudulently. Subject to the foregoing, neither we nor our employees, or agents accept liability for the correctness of such opinions and all conditions and warranties, whether relating to description, condition or quality of lots, express, implied or statutory, are hereby excluded.
  3. Time Warp has taken all reasonable care to describe the condition of the lots in the catalogue as accurate as possible. The rating of condition and description of each lot are given by the assessors of Time Warp at their best knowledge. However, all bidders are advised not to entirely rely on the full description of the condition of lots. They must rely solely on their own knowledge and inspection before bidding to determine such issues as age, quality, character, physical condition, mechanical and electrical function and rarity, etc.
  4. The historical background in relation to the lots shall not be reckoned as part of the lot description. All bidders are advised to conduct their own adequate research on the background history of the lots before placing their bids.

Withdrawal of Lots

  1. Time Warp reserves, in its unfettered discretion, the right to withdraw any lots from the catalogue before the auction.

Bidding

  1. Bid form can be submitted via the website www.golden-age.hk or by returning completed hard copy form and documents of identification to the office of Time Warp in Hong Kong. The completed hard copy form and the said documents must be deposited in drop-in box labelled “Rarity – Hong Kong 2015” before the deadline.
  2. The bid form must be completed in either English (BLOCK LETTERS) or Chinese. Incorrect or incomplete information will render the bid submission invalid and the bid submission will be rejected without notice.
  3. Bidders must provide correct information, including a valid Hong Kong Identity Card or a passport number (Hong Kong Special Administrative Region or another country's) and a valid Hong Kong or overseas correspondence address and phone number. Bidders must ensure that the contact details provided in the bid submission are correct. Otherwise, the bid submission will not be processed.
  4. Each bidder can submit only one bid form (either online or hard copy). If a bidder submits more than one form, all of the bid submissions under that bidder's name will be disqualified regardless of whether they are submitted online, in hard copy, or via both channels.
  5. Hard copy bid form (FORM A) and documents of identification (see Paragraph 3 of "Bidder Registration" above) must be placed inside a sealed envelope and submitted via drop-in box labelled 'Rarity – Hong Kong 2015' at our office from 28 November 2015 (Saturday) to 4 December 2015 (Friday) (Monday to Friday: 09:00 and 17:30; Saturday: 09:00 - 15:00). Bid submission received after the deadline will not be accepted. No mail or fax bid submission will be allowed. 
  6. Online bid form can be submitted from now onwards to 23:59 on 4 December 2015. Before making the online bid submission, the bidder should fax the documents of identification (see Paragraph 3 of "Bidder Registration" above) together with FORM B to (852)2850 8958 in order to obtain prior online bid approval. FORM B can be downloaded from our website www.golden-age.hk. We will inform the bidder via email if his/ her online bid application is approved. An identification approval code will be given in this email and the eligible bidder must provide such code when completing the online bid form.
  7.  Bid submission without documents of identification will not be processed. 
  8.  Bid forms cannot be changed or withdrawn after submission.
  9. Each lot has a private reserve price. Time Warp has full discretion to refuse any bids placed that are deemed too low and withdraw a lot from sale. 
  10. Time Warp reserves the right to adjust the deadline for bid submission.

(B)    After the Auction

Bidding Results

  1. The bidding results will be available upon request via email after 7 December 2015.
  2. All successful bidders will receive a notification letter and an invoice, sent by ordinary post or email, with the payment details and collection arrangement. 

Payment

  1. Successful bidders must pay the full amount due (including any applicable bank charges for payment) by 17:00 on or before the seventh working day (excluding Saturdays) following the date of the said notification letter. 
  2. Time Warp accepts payment by cash, cheque, bankdraft, bank transfer or tele-transfer. All bank charges in relation to the payment are solely borne by the successful bidders. Payment must be settled in Hong Kong dollars. Cheques should be drawn on a bank account in Hong Kong Special Administrative Region and made payable to “Time Warp Fine Art Limited”. It will be necessary to allow at least two working days for the cheque to clear before collecting the lots.
  3. Successful bidders will receive possession of the lots only when payment has been made in full and all funds have been cleared. Title and risk of loss will pass to the successful bidders when the successful bidders have taken possession of the lots.
  4. Time Warp might, at its own discretion, cancel any successful bid if the bidder does not pay the full amount due (including any applicable bank charges for payment) by 17:00 on or before the seventh working day (excluding Saturdays) following the date of the said notification letter.
  5. In case of non-payment, Time Warp might, at its own discretion, resell the unpaid lot(s) again. The successful bidder has no rights to make any claims to the unpaid lot(s) or make any opposition to the resale.

Collection of Lots

  1. Time Warp will not provide any delivery service. It is the successful bidders’ responsibility to collect the lots and make all shipping arrangements. 
  2.  Successful bidders can either collect the lots in person or authorise any third parties such as courier to collect the lots.
  3. Successful bidders must present an authorisation letter (FORM C) to Time Warp before the collection if an authorized third party is assigned to collect the lot(s). FORM C can be downloaded from our website www.golden-age.hk.
  4. Time Warp will reject a third party to collect the lot(s) if no authorization letter (FORM C) is presented by the successful bidder(s).
  5. Successful bidders or their authorized agents must collect the lots from the office of Time Warp by 17:00 on or before the seventh working day (excluding Saturdays) following the payment. Time Warp reserves, in its unfettered discretion, the right to dispose the uncollected lot(s) and donate the proceeds to charity.
  6. Time Warp will not bear any responsibility and/or liability for any damage or loss of the lot(s) during transportation or shipment after the collection.
  7. If a tropical cyclone warning signal number 8 or above, or a Black rainstorm warning signal is in force in Hong Kong Special Administrative Region on the collection deadline, Time Warp will inform successful bidders another date for collection.

Packing & Insurance

  1. Time Warp will not provide any professional packing service of the lot(s). Successful bidders are advised to engage the relevant service providers to pack the lot(s) before collection.
  2. Successful bidders are advised to purchase their own shipping insurance for the lot(s) before the collection.

Export or Import Licences

  1. The lot(s) sold at auction may be subject to laws governing export from Hong Kong Special Administrative Region and import restriction of foreign countries. If any relevant export or import licence is required, it is the successful bidders’ sole responsibility to obtain it. Any denial of or delay in licence applications shall not justify the rescission of any sale nor any delay in making full payment or item pick up. 
  2. Time Warp has discretionary power to consider extending the collection deadline after full payment is received from the successful bidders if the processing time for licence applications exceeds the said deadline.

Forgery Dispute & Refund

  1. Sale of any lots will be cancelled and the full payment amount (excluding bank charges for the payment) will be refunded to the successful bidders if the lot(s) sold is/are proved to be forgeries. In such case, the successful bidders must produce sufficient scientific evidence acceptable and satisfactory to Time Warp that the said lot(s) is/are forgeries.
  2. The said evidence must be produced within thirty calendar days following the collection date of the lot(s). 
  3. The lots in concern should be returned in the same condition and with the same package as at the collection date. Otherwise, Time Warp can decline the return request. 

Limitation of Liability

  1. In any circumstances, Time Warp's liability to a successful bidder shall not exceed the purchase price actually paid.
  2. Time Warp takes no responsibility for any mistakes, errors or omissions in the catalogue. All information in the catalogue is compiled solely for the auction. Time Warp shall not be liable in any circumstance for further use of information provided in this catalogue. Reproduction of all or any part(s) of this catalogue is not allowed without written permission from Time Warp.

Other Terms and Conditions

  1. In case of any dispute, Time Warp's decision shall be final and conclusive.
  2. These terms and conditions shall be construed and governed in accordance with the laws of Hong Kong Special Administrative Region.
  3. In the event of any discrepancy or inconsistency between the English and Chinese versions of these terms and conditions, the English version shall apply and prevail.
